1. General arrangement

These general conditions of sale (hereinafter the "General Conditions") apply to all products sales (hereinafter "Products" or "Product") purchased through the website www.dolcepiemonte.com (hereinafter, " Site ").
The site www.dolcepiemonte.com is owned by the LAGGIARD PACKAGING SERVICE sas (Hereinafter referred to as LPS), also the photographic material of the site and the exclusive property of LPS and may not be reproduced.

The use of e-commerce service described in these Terms and Conditions is reserved exclusively for consumers (hereinafter "Customer" or "Customer"), understood as natural persons acting for purposes outside his trade, business or professional activity.

The Customer must read these Terms and Conditions which have been made available on the Site, in order to allow the storage and reproduction by the Client pursuant to art. 12 of DL 9 April 2003 n. 70.
Contracts with LPS (as defined below) through the Site are governed by Italian law and in particular by DL 6 September 2005, n. 206 ("Consumer Code") and DL 9 April 2003, n. 70 (hereinafter " Ecommerce Decree ").

3. Information relating to the Products

The information relating to products subject to e-commerce through the Site are available on the Site. These information is provided in accordance with Articles 52 and 53 of the Consumer Code.



4. Price

Product prices are inclusive of all taxes and fees. All prices are expressed in Euro. The shipping costs are the responsibility of the customer, except for eventual promotions, and are visible in the shopping cart page before finalizing the order.

5. Order of Products

The essential features and prices of the products are given in the offer for each Product.
To purchase the chosen Product the Customer shall complete and submit to LPS the order form in electronic format, following the instructions contained in the Site. The Customer shall add the Product into "shopping cart" and, after having read the present Terms and Conditions, with particular reference to the contribution towards the cost of delivery and the means of exercising the right of withdrawal and the Privacy Policy, he must select the desired payment method and choose the "Buy" button.



Before he submit his purchase order the Customer will have the opportunity to correct any errors in data entry by following the proper procedure for modification contained in the Site. In particular, the Customer has the right to modify the number of Products he intends to buy, adding or deleting one or more Products from his "shopping cart".

LPS reserves to itself the right to evaluate the acceptance of orders received. LPS inform the Customer is unable to accept any orders received within 30 days from the day after that on which the customer has sent the order to LPS and will refund any amounts already paid by the Customer for payment of the supply. 
In the event the CUSTOMER intends to place an order by e-mail at info@dolcepiemonte.com, or does not intend to register online, he/she must, before placing a new order, follow the full procedure for reading and accepting these contract conditions. For orders made by e-mail, LPS sas reserves the right to request a copy of an identity document in order to ensure the purchaser is over 18.

6. Methods of payment

The Customer can pay the Products and the shipping cost by credit card or PayPall.

At the time of the order confirmation, the data of the consumer's credit card will be transferred via secure connection SSL (Secure Socket Layer), on-site PAYPAL. 
Under no circumstances LPS will receive the number of the credit card consumer. LPS will get only the authorization by the credit card. This procedure it's absolutely secure and it guarantees both the consumer and LPS.



In the event that, for whatever reason, payment of the amounts owed by the Customer is not practicable, the selling process is automatically canceled and the sale is canceled automatically.


7. Confirmation of order receipt
In accordance with art. 53 of the Consumer Code, the Customer receives, at the time of the contract, by e-mail, confirmation of receipt of the order placed by the Customer.
If the customer does not receive any confirmation, the purchase order is considered canceled.



8. Order Inefficacy
No contract shall be concluded between LPS and customer if LPS has reasonable reasons to believe that the customer does not operate on the basis of an effective and genuine interest in the purchase of products ordered, or abusively exercising the right of withdrawal conferred by Article 10 that follows. In such cases, the order submitted by the Customer shall be understood with no effect whatsoever.
 LPS will send to the Customer, via e-mail, a notice about the failure to conclude the Agreement, LPS also taking care of the cancellation of any debit and / or charge to the customer.

9. Transport and delivery

The Products purchased on the Site will be sent to the address indicated by the Customer. The customer has in any case the right to demand delivery of the goods to a person of his choice. At the time of delivery will require the signature of an adult over 18 years. Deliveries can’t be made to PO boxes.

For each order completed on Site, LPS emits a document for shipped Products, an electronic copy of this document is stored in the personal profile of the customer, in accordance with DPR 445/2000 and Legislative Decree no. 52/2004.

Delivery costs are charged to the customer and are clearly indicated on the Site and in the order form.
All purchases will be delivered by courier Monday to Friday, excluding national holidays and festivities. LPS is not responsible for unpredictable delays.

In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code will be delivered within a maximum period of 30 (thirty) days from the working day following that on which the customer has sent the order to LPS, except that LPS does not communicate - within the same period, by e-mail - the inability to deliver the goods ordered due to sudden and temporary unavailability of the Products. In the event of such communication, LPS will refund any amounts already paid by the Customer for payment of the supply. In case of these notice from LPS to a delay in the date of delivery, the Client wishes to cancel the whole order, any amount already paid by the same shall be refunded as soon as possible, but no later than 30 (thirty) days from the day following that on which the customer has sent the order to LPS.
For the delivery of the goods it is required the presence of the customer or his representative at the address indicated in the order. At the delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to that indicated in the transport document and that the package is intact or altered. Any damage to the parcel and / or to the Products or the mismatch in the number of packages must be immediately notified in writing on reserve through the proof of delivery courier. Once signed the Courier's transportation document, the Customer may not oppose objection on the external characteristic of the delivered package.

10. Right of withdrawal

Pursuant to UE n° 2011/83, the customer is entitled to withdraw from the purchase contract for any reason, without explanation and without penalty.

To exercise this right, the customer must send LPS notice within 14 working days from the date of receipt of the goods. Such notice shall be sent by registered letter with acknowledgment of receipt, addressed to:

Or by fax (+39 0121.342592) sent within the said period of 10 days, followed by a confirmation by registered letter with acknowledgment of receipt. Once we have received the notice of withdrawal, the Customer Service of www.dolcepiemonte.com will notify the customer all instructions on how to return the goods which must be received in our warehouse within 10 days from authorization.

The right of withdrawal is subject to the following conditions:


  1. The withdrawal applies to product purchased in its entirety, it can be exercised the withdrawal on a part of the product purchased.

  2. By law, the shipping costs for return of the goods shall be borne by the customer.

  3. The expedition, until the certificate of receipt in our warehouse is under the responsibility of the customer.

  4. LPS is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.
  5. If the goods are damaged in transit, LPS will notify the customer (within 5 working days of receipt of goods in their stores), to enable him to file a complaint against the carrier of his choice and to obtain reimbursement of the value of the good (if insured).

In this case, the product will be made available to the customer for his return while canceling the request for withdrawal.

LPS will refund to the customer the full amount paid within 30 days of return of the goods, by following the transfer of the amount charged to the credit card or by bank transfer. In the latter case, the Buyer shall provide to the bank on which to obtain a refund (ABI - CAB - Account of the invoice).

The right of withdrawal is lost for lack of the essential integrity of the property (the packaging and / or its contents), where LPS finds:
a. The lack of the outer and / or packaging containing the product (eg cake, cookies, etc. ..)
b.
The product is damaged for causes other than its transport.

In case of forfeiture of the right of withdrawal, LPS will return to sender the purchased good by charging him the shipping costs.

11. Lack of conformity
In case of lack of conformity of Products sold by LPS through dolcepiemonte.it, the Customer shall immediately contact the e-mail info@dolcepiemonte.com.

Products sale are subject to the legal safeguards provided for in Articles 129, 130 and 132 of the Consumer Code. The customer has the right to restore, without charge, the conformity of the goods by repair or replacement or to have an appropriate reduction of the price or the contract rescinded. The customer will lose those rights, if not complaint to LPS the lack of conformity within a period of two months from the date on which he discovered the defect.

12. Errors

The information relating to the Products are provided on the Site constantly updated. However it is not possible to guarantee the complete absence of errors.

LPS reserves the right to correct any errors, inaccuracies or omissions, including after an order has been sent, and also to change or update information at any time without prior notice.


13. Applicable law and jurisdiction

These Terms and Conditions are governed by Italian law and shall be interpreted in accordance with Italian laws.

For disputes arising from the interpretation, validity and / or execution of these General Conditions the territorial imperative is that of the court of Turin (Italy).
